Title

Authorizing the City of Saint Paul to enter into a license agreement with Interstate Parking Company of Minnesota LLC, 120 South 6th Street, Suite 2005.

 

Body

WHEREAS, Interstate Parking Company (the “Company”) leases and manages the Lowry Ramp at 349 Wabasha Street (the “Property”) pursuant to a master agreement with the head landlord of the premises (the “Owner”); and

 

WHEREAS, the City of Saint Paul (“City”) wishes to enter upon that portion of the Property, managed by the Company, as depicted in the attached aerial map, Exhibit A, for purposes of storing project materials and parking contractor vehicles as part of the City Hall Annex north wall repair project; and

WHEREAS, the City and the Owner have mutually prepared the License for the City's use of the Property, attached hereto as Exhibit B, and the City wishes to enter into a license agreement (“License”) with the Company; and

 

WHEREAS, the City will require the selected contractor to only use the Property for the permitted uses and for no other purpose. The City will properly and reasonably supervise all persons on the Property during the term of the License, and the contractor will obtain all necessary permits, licenses and authorizations to conduct the permitted uses at the Property; and

 

WHEREAS, said License requires indemnification by the City and its contractors for any claims, damages, liabilities and costs related to the City's use of the Property, and the contractor will be required to accept these obligations and hold the city harmless from any such claims, and to carry insurance sufficient to cover such obligations; now, therefore, be it

 

RESOLVED, that the Mayor and City Council do hereby approve said License in a form and content substantially as set forth in Exhibit B, and authorize and direct the proper city officials to execute said License.
