Body
WHEREAS, the Auto Body Repair/Painting Shop license held by Duqueiro Cano d/b/a Duke’s Cars & Towing (License ID# 20120001127) for the premises located at 323 Maria Avenue was the subject of a Notice of Violation dated July 20, 2018; and

WHEREAS, the Notice stated that during a complaint-based site visit of the licensed premises on June 5, 2018, an inspector from the Department of Safety and Inspections (DSI) documented with photographs a violation to license condition #7 regarding exterior storage; and

WHEREAS, during that site visit, the inspector also observed two (2) vehicles parked on the premises and took photographs and spoke with the licensee on the phone concerning the exterior storage violation and stated he would be back for a re-inspection in seven (7) days; and

WHEREAS, when the inspector returned on June 13, 2018, he discussed the license conditions with the manager and stated he would be back within ten (10) days; and

WHEREAS, when the inspector returned on June 20, 2018, he observed the same two vehicles parked on the premises that had been there on June 5, 2018 in violation of license condition #11 regarding vehicles not being allowed to park on the premises more than ten (10) days; and

WHEREAS, per Saint Paul Legislative Code § 310.05 (m) (1), the licensing office recommended a $500.00 matrix penalty; and

WHEREAS, the licensee did not respond to the Notice of Violation to pay the $500.00 matrix penalty or request a public or administrative hearing; and

WHEREAS, the Notice of Violation stated that if the licensee failed to pay the $500.00 matrix penalty or request a public or administrative hearing by July 30, 2018, that the matter would be placed on the August 15, 2018 consent agenda to impose the recommended penalty; now, therefore, be it
