Approving a request by 443 Lafayette Park Owner LLC to release easements over a portion of the property at 443 Lafayette Road.

WHEREAS, a request has been received from 443 Lafayette Park Owner LLC, a Delaware limited liability company, for the release of existing water easements, legally described as:
The southeasterly 30 feet of the northwesterly 48 feet of vacated East Ninth Street between the east line of vacated John Street and the west line of Lafayette Road,
and as stated and depicted in recorded Ramsey County document No. 2345211 and Council File No. 86-1037 (conditions and reservations # 7, parcel 6); and
WHEREAS, the Saint Paul Regional Water Services has determined that said easements, as they apply to the above property, may be released; now, therefore be it
RESOLVED, that with the accompanying Certificate of Intended Non-Use, filed voluntarily on behalf of the Saint Paul Regional Water Services for the City of Saint Paul and made a part hereof by this reference, the City for itself and on behalf of said Department, waives its right to the easements described above; and be it further
RESOLVED, that upon passage of this resolution and the City's receipt of a $300.00 administrative processing fee, the proper City officials are hereby authorized to record a certified copy of this resolution in the office of the Ramsey County Recorder and/or Registrar of Titles.
