Approving adverse action against all licenses held by Tony's Amoco, Inc., 374 Lexington Parkway North.
 
Body
WHEREAS, adverse action was taken against all licenses held by Tony's Amoco, Inc. d/b/a Tony's Amoco, Inc. (License ID #20010001039) for the premises located at 374 Lexington Parkway North in Saint Paul by Notice of Violation dated November 1, 2012, alleging the licensee failed to provide Saint Paul Police a copy of video surveillance dealing with an incident at the licensee's establishment on October 23, 2012; and   
 
WHEREAS, failure to provide video surveillance upon request of the Saint Paul Police Department is a violation of license condition #2; and
WHEREAS, as a result of this violation, the licensing office recommended a $500.00 matrix penalty; and
 
WHEREAS, on November 21, 2012, the Department of Safety and Inspections received a letter from the licensee admitting to the facts and requesting the fine be waived;
WHEREAS, DSI understood this response to be a request for a public hearing which was held on December 19, 2012; now therefore be it
RESOLVED, that Tony's Amoco, Inc. d/b/a Tony's Amoco, Inc., is hereby ordered to pay a $500.00 matrix penalty for failure to provide video surveillance upon request of the Saint Paul Police Department in violation of license condition #2.  Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.     
 
This resolution, and action taken above, is based upon facts contained in the November 1, 2012, Notice of Violation sent to the licensee and the arguments made at the public hearing on December 19, 2012.
