Approving a request by Keith Schweiger to release easements over a portion of his property at 1161 University Avenue West.
Body
WHEREAS, a request has been received from Keith Schweiger for the release of existing easements for slopes, cuts and fills in grading and surfacing with bituminous materials the alley within the property as depicted on Exhibit A attached hereto, and legally described as:
That portion of the Slope Easement per document numbers 1300700 <tel:1300700>and 315425 over the East Half of Lot 26 and all of Lots 27, 28, 29 and 30, Block 7, Sanborn's Midway addition to St. Paul, Minn., according to the recorded plat thereof, Ramsey County, Minnesota
; and
WHEREAS, the easement rights requested to be released are stated and depicted in recorded Ramsey County document numbers 1300700 <tel:1300700>and 315425; and
WHEREAS, the Saint Paul Department of Public Works has determined that said easements, as they apply to the above property, may be released; now, therefore be it
RESOLVED, that with the accompanying Certificate of Intended Non-Use, filed voluntarily on behalf of the Department of Public Works for the City of Saint Paul and made a part hereof by this reference, the City for itself and on behalf of said Department, waives its right to the easements described above; and be it further
RESOLVED, that upon passage of this resolution, said easement rights are released and the proper city officials are hereby authorized and directed to record a copy of said resolution in the office of the Ramsey County Recorder and to file a copy of said resolution in the office of the Ramsey County Registrar of Titles, and that the City Clerk shall maintain on file a copy of the Certificate of Intended Non-Use referenced in this resolution.
