WHEREAS, in the matter of the Appeal of Jeff DeLisle, DeLisle Co. Realtors, to a Re-Inspection Fire Certificate of Occupancy With Deficiencies (updated) at 1085 HATCH AVENUE, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
 
WHEREAS, the Legislative Hearing Officer recommends that the City Council deny the appeal and grant an extension to November 1, 2012 to bring the driveway into compliance by removing the mulch and adding Class 5; Now, Therefore, Be It
 
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
