WHEREAS, in the matter of the Appeal of Gordon Mergens to a Re-Inspection Fire Certificate of Occupancy Correction Notice at 238 LEXINGTON PARKWAY NORTH, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
WHEREAS, the Legislative Hearing Officer recommends that the City Council: 1) regarding painting the exterior - grant the appeal on the north and west side; deny the appeal and grant an extension to January 1, 2013 on the east side and July 1, 2013 on the south side; 2) deny the appeal on electrical repairs and grant an extension of 90 days for compliance (note required corrections being addressed under permit at this time); 3) grant the appeal regarding access to the circuit breakers on the condition that full disclosure be made to building tenants that access is through the caretaker's unit; 4) deny the appeal relating to clearing the path to the utility room (noting work is complete); 5) grant the appeal regarding the dryer exhaust, noting the work was completed under permit; and 6) deny the appeal regarding ceiling sheetrocking in the garage and grant an extension to July 1, 2013; Now, Therefore, Be It
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
