Granting permission for the City of Saint Paul to enter into and execute a License Agreement with Xcel Energy for the creation of a dog park using Xcel's land identified as the High Bridge Commons.
Body
WHEREAS, the City of Saint Paul Department of Parks and Recreation has identified a need for additional dog parks in the city; and
WHEREAS, Northern States Power, d/b/a Xcel Energy, has a large parcel of open land on the site of its former coal fired generating plant, referred to as the High Bridge Commons; and
WHEREAS, Xcel Energy is willing to grant the City a license at no cost to use the High Bridge Commons site as a dog park, open to the public, subject to certain conditions, including an indemnification clause; and
WHEREAS, the council finds that the expenditure of money, which includes the promise of indemnification, has a public purpose in that it will permit the Department of Parks and Recreation to use this site to provide a much desired amenity to the public; now, therefore, be it
RESOLVED, that the City Council of the City of Saint Paul hereby authorizes the appropriate city officials to enter into the attached License Agreement with Northern States Power Company, which includes indemnification language.
