Appeal of Angela Goss, on behalf of CMP3, LLC, to a Re-Inspection Fire Certificate of Occupancy With Deficiencies at 957 THIRD STREET EAST.
Purpose of Appeal
1. Basement water heaters for both units have been in basement since we purchased and renovated home in 2008. See attached C of O from Steve Zaccard Fire Marshall dated November 24, 2008. These have not been an issue and request that we can leave them both where they are installed. We could lock both residents out of basement if you prefer?
2. Egress Windows in lower unit (double hung) south bedroom is 14.5 w by 29.5 h-openable and 13.5 w X 65 h-glazed. Request variance from openable width by 5.5 inches but we are 5.5 inches higher than required height. Please note we have two windows that are identical. Code requires 44 sq. inches and our window is 44 sq. inches. We believe we meet the glazed area requirement.

WHEREAS, in the matter of the Appeal of Angela Goss, on behalf of CMP3, LLC, to a Re-Inspection Fire Certificate of Occupancy With Deficiencies at 957 THIRD STREET EAST, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
WHEREAS, the Legislative Hearing Officer recommends that the City Council deny the appeal on the lower unit south bedroom egress window and grant a 90-day extension for compliance, and deny the appeal on the water heaters and grant an extension to September 1, 2012 for compliance; Now, Therefore, Be It
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation grants the appeal in this matter.
