Purpose of Appeal
Units 1 & 2 have egress windows with ladders permanently affixed to the wall.  Unit 1 is 12 inches from sill.  Unit 2 is 42 inches.  Request was made to replace with steps 48 inches from sill.  We would like keep the ladders, which are closer to sill, allowing easier exit.  Units 1, 3, and 5 have double hung windows with openings of 20 inches high X 29.5 inches wide (4.92 sq. ft. opening).

Body
WHEREAS, in the matter of the Appeal of Brad Leventhal to a Re-Inspection Fire Certificate of Occupancy With Deficiencies at 441 GRAND AVENUE, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
 
WHEREAS, the Legislative Hearing Officer recommends that the City Council grant a 6.5-inch variance on the openable height of the egress windows in Unit 1 south bedroom and Units 3 and 5 south bedrooms; and grant the minimum sill height for Unit 1 north bedroom and Unit 2 bedroom on the condition that four handholds are installed on each side of the ladders ; Now, Therefore, Be It
 
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
