Title

Approving a Limited Use Permit with the State of Minnesota Department of Transportation for a pedestrian trail in the right-of-way of Trunk Highway 52 at Plato Boulevard and Trunk Highway 952A at Robert Street South.

 

Body

WHEREAS, the City of Saint Paul (“City”) has approved plans to construct, operate and maintain, for pedestrian and bicycle use, the Robert Piram Regional Trail (the “Trail”) between Harriet Island in Saint Paul and Kaposia Park in South Saint Paul; and

 

WHEREAS, portions of the Trail would be located along Plato Boulevard within State of Minnesota Trunk Highway 52 (Lafayette Freeway) and Trunk Highway 952A (Robert Street South); and

 

WHEREAS, to authorize the construction and use of the Trail crossing, and to promote the orderly and safe crossing of the highways, the State of Minnesota, Department of Transportation (“MnDOT”) requires a Limited Use Permit between the City and MnDOT, attached hereto as Exhibit A;

WHEREAS, as a requirement of the Limited Use Permit MnDOT requires that the City agree to indemnify MnDOT; and


WHEREAS, the City Council finds that the construction of the Robert Piram Regional Trail has a legitimate public purpose in providing additional recreational opportunities to the public; and

WHEREAS, the expenditure of public funds, which includes the promise of indemnification and defense, will facilitate that public purpose; now, therefore, be it

 

RESOLVED, that the Mayor and Council of the City of Saint Paul hereby approve said Limited Use Permit, and authorize the proper city officials to execute same and any amendments that may be mutually agreed to between the City and MnDOT.
